Welcome to Moda HomeGoods. These Terms of Service ("Terms") govern your use of the Moda HomeGoods website and your purchase of products and services from us.

By accessing our website, placing an order, making a payment or deposit, or otherwise purchasing products or services from Moda HomeGoods, you agree to these Terms, together with our Shipping & Delivery Policy, Return, Exchange & Cancellation Policy, Privacy Policy, and any other policies displayed on our website.

1. GENERAL TERMS

By using this website, you confirm that you are legally capable of entering into a binding agreement or that you are using the website with the permission and supervision of a parent or legal guardian.

Moda HomeGoods reserves the right to refuse service, cancel transactions where legally permitted, limit quantities, or restrict access to the website where reasonably necessary to protect our business, customers, systems, or legal rights.

2. PRODUCTS & AVAILABILITY

Moda HomeGoods offers furniture, home décor, bedding, rugs, accessories, household products, and other home-related merchandise.

All products are subject to availability.

Items displayed on our website may be:

• Available from our warehouse
• Pre-order merchandise
• Special-order merchandise
• Limited-stock merchandise
• Clearance or final-sale merchandise

Adding an item to your shopping cart does not guarantee availability or reserve the merchandise.

If an item becomes unavailable after an order has been placed, we will contact you regarding the available options.

3. PRODUCT IMAGES, COLOURS & DESCRIPTIONS

We make reasonable efforts to display our products as accurately as possible.

However, colours, textures, finishes, patterns, wood grains, marble patterns, fabrics, and other product characteristics may appear differently depending on lighting, photography, screen settings, manufacturing batches, and the natural characteristics of certain materials.

Minor variations are not necessarily considered defects.

Product dimensions are approximate unless specifically stated otherwise.

Customers purchasing furniture or oversized items are responsible for reviewing measurements and ensuring that products are suitable for their intended space and can fit through doors, elevators, staircases, hallways, gates, and other access points.

4. PRICING

Prices are displayed in the currency indicated on the website and are subject to change without notice.

Moda HomeGoods makes reasonable efforts to ensure that pricing and product information are accurate. However, typographical, technical, pricing, promotional, or inventory errors may occasionally occur.

If an obvious pricing or product information error affects an order, we reserve the right, subject to applicable law, to contact the customer to correct the error, offer the option to proceed at the correct price, or cancel and refund the affected transaction.

5. PAYMENTS

Payment must be made using one of the payment methods accepted by Moda HomeGoods.

Orders are not considered fully confirmed until the required payment or deposit has been successfully received and, where applicable, verified.

Customers are responsible for ensuring that payment and billing information provided is accurate.

Moda HomeGoods reserves the right to request reasonable verification before processing transactions where fraud or unauthorized payment activity is suspected.

6. PRE-ORDERS & SPECIAL ORDERS

Pre-order and special-order merchandise is ordered specifically from our suppliers and may not be immediately available in-store.

Estimated arrival for most pre-order merchandise is approximately 2–5 weeks, depending on the supplier and shipping circumstances.

This timeframe is an estimate and not a guaranteed delivery date.

International freight schedules, supplier delays, customs processing, port delays, weather, transportation disruptions, public holidays, and other circumstances outside our reasonable control may affect estimated arrival dates.

Moda HomeGoods will provide reasonable updates regarding the progress of pre-order merchandise as information becomes available.

Customers should carefully review the product, dimensions, colour, quantity, specifications, estimated timeframe, and other relevant details before confirming a pre-order.

7. ORDER CANCELLATIONS

Cancellation requests are governed by our Return, Exchange & Cancellation Policy.

Pre-orders may generally be cancelled within 24 hours of purchase, provided the supplier order has not already been processed or confirmed.

Once Moda HomeGoods has committed funds, submitted the supplier order, purchased the merchandise, or incurred non-recoverable costs relating to a special order or pre-order, cancellation and refund options may be restricted.

Any applicable supplier cancellation fees, freight charges, transaction costs, or other non-recoverable expenses may be deducted where legally permitted and disclosed.

8. SHIPPING & DELIVERY

Shipping and delivery are governed by the Moda HomeGoods Shipping & Delivery Policy.

In-stock and local warehouse merchandise is generally expected to be delivered within approximately 1–3 business days after order confirmation, subject to availability and delivery arrangements.

Pre-order merchandise generally has an estimated arrival timeframe of approximately 2–5 weeks.

Delivery estimates are not guarantees.

Customers are responsible for providing accurate delivery addresses, telephone numbers, access instructions, and other information necessary to complete delivery.

Additional fees may apply for redelivery, difficult access, additional labour, special handling, or other services where applicable.

9. DELIVERY ACCESS & MEASUREMENTS

Customers purchasing furniture and oversized merchandise are responsible for ensuring that the item can safely enter the property and fit within the intended space.

Please measure all relevant:

• Doorways
• Hallways
• Staircases
• Elevators
• Gates
• Rooms
• Entryways
• Other access points

before completing your purchase.

Moda HomeGoods is not responsible for an item being unable to fit into a customer's property or intended location where the item's dimensions were provided or reasonably available before purchase.

10. INSPECTION OF MERCHANDISE

Customers should inspect merchandise at the time of delivery or pickup.

Visible damage, missing components, or incorrect merchandise should be reported to Moda HomeGoods as soon as possible and preferably within 24 hours of receipt.

Photographs or videos may be requested to assist with evaluating a claim.

Moda HomeGoods will review valid claims and determine the appropriate remedy in accordance with applicable law and our Return, Exchange & Cancellation Policy.

11. RETURNS, EXCHANGES & REFUNDS

Returns, exchanges, cancellations, and refunds are governed by our Return, Exchange & Cancellation Policy.

Eligible merchandise may generally be returned or exchanged within 5 days of receipt, subject to the conditions stated in that policy.

Certain products may be designated final sale, including qualifying clearance merchandise, customized or special-order products, opened personal-use textiles, and other merchandise identified as non-returnable, subject to applicable consumer law.

Nothing in these Terms is intended to exclude or limit any right or remedy that cannot legally be excluded under applicable consumer protection laws.

12. PROMOTIONS, SALES & DISCOUNT CODES

Promotions, coupons, discount codes, sales, and special offers are subject to their stated terms, availability, and expiration dates.

Unless otherwise stated:

• Discounts cannot be combined.
• Promotional codes cannot be applied retroactively.
• Promotions have no cash value.
• Promotions may exclude certain merchandise or services.
• Promotional pricing is valid only during the advertised promotional period.

Moda HomeGoods reserves the right to correct genuine promotional errors or discontinue promotions where permitted by law.

16. REVIEWS, PHOTOS & CUSTOMER CONTENT

If you voluntarily submit a review, testimonial, photograph, video, or other content to Moda HomeGoods for publication or promotional use, you confirm that you have the right to provide that material.

Where permission has been given for promotional use, Moda HomeGoods may use the submitted material in connection with its website, social media, advertising, and marketing, subject to applicable law.

19. FORCE MAJEURE & EVENTS OUTSIDE OUR CONTROL

Moda HomeGoods will not be responsible for delays or failure to perform obligations caused by events reasonably outside our control, including severe weather, natural disasters, supplier disruptions, shipping or freight interruptions, customs or port delays, strikes, transportation disruptions, government actions, power or telecommunications outages, or similar events.

Where such circumstances affect an order, we will make reasonable efforts to communicate with the affected customer and complete the order as soon as reasonably possible.

20. PRIVACY

Customer information is handled in accordance with our Privacy Policy and applicable data protection requirements.

By using our website, you acknowledge that certain information may be collected and processed as necessary to provide our services, fulfill orders, process payments, communicate with customers, and operate our business.
